Terms of sale
1. Applicability of the sales conditions
1.1. Upon purchase of goods and/or services from Perfect Home’s Web shop, these sales conditions shall enter effect between the buyer (hereinafter ‘the Customer’) and the company Perfect Home Logistics OÜ (hereinafter ‘the Web Shop’).
1.2. In addition to these terms of sale, the legal relations arising in the purchase of products from the Web Shop shall be subject to Estonia’s Law of Obligations Act, the Consumer Protection Act, and other legal acts in force in the Republic of Estonia.
1.3. The Web Shop shall retain the right to make amendments to the sales conditions. All such amendments shall be made available on the Web site www.perfecthome.com.
2.1. All prices listed in the Web Shop interface are inclusive of value added tax at the rate of 20%.
2.2. The postage and packing price applicable for the delivery method selected by the Customer (with logistics partner Omniva) shall be added to the prices and listed before check-out.
2.3. The prices shall be valid from the time of the order (the moment of check-out in the Web Shop) until receipt of payment.
2.4. If amendments are made to the sales conditions or prices after an order is placed, the conditions applicable at the moment of check-out shall be applied to the legal relations created by that order between the Customer and Perfect Home Logistics OÜ.
2.5. The Web Shop shall retain the right to make amendments to the prices. Any such amendments shall be noted on the Web site www.perfecthome.com.
3. Orders and check-out
3.1. The first stage in the order process is to add the desired products to the ‘shopping cart’.
3.2. After you have selected all of the desired products and added them to the shopping cart, click ‘Proceed to checkout’.
3.3. This is the moment of check-out. Please fill in the required data on the checkout page, choose the desired method of delivery and payment, agree to the Terms of Sale and follow the link ‘Place order now’. After this you can pay easily through the bank link or PayPal payment system. Payments are made through a safe payment system that is independent of the Web Shop, and the Perfect Home staff have no access to the Customer’s bank or credit card details.
3.3.1. With the bank links there are two possibilities.

For Estonian and Latvian customers there is a Maksekeskus payment system where the banks available for payment are Swedbank, SEB, LHV, Danske Bank, Nordea, and Krediidipank in Estonia, and Swedbank, SEB and Nordea in Latvia. Payment, in the amount shown, is made to Maksekeskus AS who will deliver it directly to the Perfect Home Web shop. Your bank statement will show Maksekeskus AS as the recipient of the payment.

In Lithuania, customers are redirected to a Paysera payment system where they can choose the following payment methods: Swedbank, SEB, DNB, Danske bank, Nordea, Citadele, Šiaulių bankas, Medicinos bankas, LKU, Mokilizingas leasing or Paysera user account can also be used. Payment, in the amount shown, is made to Paysera LT who will deliver it directly to the Perfect Home Web shop. Your bank statement will show Paysera LT as the recipient of the payment.
3.3.2. In the PayPal payment system, you can pay from a PayPal account or with any of various debit or credit cards.
3.4. Be careful when entering the data on the check-out page: accurate, fully correct information in each field ensures quick and hassle-free delivery of your products, and it facilitates the settlement of any later claims or disputes.
3.5. Orders placed via the Web Shop are processed on working days (Mon.–Fri.) between 9am and 5pm. If an order is placed before 12pm, the goods are dispatched on the same day. Orders placed after 12pm on Fridays, during weekends or during national holidays are processed on the next working day.
4. Entry into force of the sales contract
4.1. Under the sales contract, the Web Shop shall transfer to the Customer goods that are in stock or that are to be prepared or acquired by the Web Shop in the future. The contract enables the transfer of ownership to the Customer. The Customer shall pay the Web Shop the amount indicated in the invoice for the goods and accept the goods.
4.2. Orders that have not been paid for shall be cancelled.
4.3. The sales contract shall enter into force upon receipt of the Customer’s payment on the Web Shop’s bank account.
5. Delivery of goods
5.1. After the sales contract enters effect, the Perfect Home Web shop shall prepare the goods that make up the order and convey the order to Perfect Home’s logistics partner for delivery.
5.2. The delivery times stated on the Web site associated with the Web Shop are calculated from the time of receipt of full payment for the order on the bank account of the Perfect Home Web shop.
5.3. To receive the delivery without any delay, the Customer must take care to submit correct and valid data for the delivery when placing the order and checking out.
5.4. The Perfect Home Web shop shall not assume liability for any delays in the delivery of the goods if the goods were delivered to a logistics partner on time but the delay arose through circumstances that the Web Shop could not have affected or foreseen.
5.5. If the Customer does not pick up the goods from the parcel terminal on time (stated in the SMS sent to Customer upon arrival of the package) or the courier fails to deliver the parcel, the goods shall be returned to the warehouse of the Perfect Home Web shop. After this, the Customer shall be contacted within five working days to agree upon the delivery of the goods. If the Web Shop fails to make contact with the Customer, the amount paid for the purchase shall be returned (less the transport cost) to the Customer within 30 calendar days.
6. Return of unwanted goods
6.1. After receipt of the goods, the Customer has the right to withdraw from the contract signed in the Web Shop within 14 days without stating a reason (for some goods or services, the Customer may not have this right; in such cases, the relevant goods and services must be listed and shall comply with Subsection 53(4) of the Law of Obligations Act). The standard form for withdrawal from the contract is provided on the Web site hosting the Web Shop, www.perfecthome.com.
6.2. In the event that the value of a product being returned decreases before the return, the Customer shall assume liability for the decrease in value if he or she has used the product in a manner other than that required for ascertaining the nature, features, and functioning of the product. To ascertain the nature, features, and functioning of a product, the Customer should handle and use that product only in the manner in which he or she is customarily allowed to in a physical shop.
6.3. For return of the goods, an application for withdrawal from the purchase contract must be submitted; the standard form for this is available on the Web site that hosts the Web Shop. The application must be sent to Perfect Home Logistics OÜ either by e-mail or by post no later than 14 days after receipt of the goods.

6.4. The Customer shall return the goods within 14 days after having submitted the application or submit a certificate proving that he or she has delivered the goods to the logistics company in said period.
6.5. The client need not return the goods through a logistics company if the Web Shop agrees to pick up the goods itself.
6.6. Upon receipt of the application for withdrawal, the Web Shop shall return to the Customer immediately (within no more than 14 days) all fees received from the Customer on the basis of the contract – including the cost for delivery of the product to the Customer. However, when the Customer has explicitly chosen a method of delivery different from the lowest-cost option offered by the company, the Web Shop shall not have to return to the Customer the amount in excess of the cost of the lowest-price (standard) method.
7. Force majeure
7.1. The Perfect Home Web shop shall not assume liability for any damages caused to the Customer or for any delays in the delivery of the goods if the damages or delays have been caused by circumstances the Web Shop could not have affected or foreseen.
8. Handling of personal data
8.1. By submitting his or her data in the Web Shop and giving the associated permission therein, the Customer grants the Web Shop the right to collect and process his or her personal data (name, contact phone number, parcel-delivery and/or home address, and e-mail address) and send his or her personal data to the logistics partner for delivery of the goods.
8.2. The Perfect Home Web shop shall have the right to use the address of the Customer’s place of residence or other stated location for sending advertisements and any other information to the Customer.
8.3. The Customer shall have the right to prohibit the keeping and use of his or her personal data at any time except when required for recovery of a claim arising from the contract or for delivery of the goods.
8.4. Personal data on means of electronic contact shall be used for direct mailings only if the Customer has granted specific permission for this on the Web site that is home to the Web Shop.
8.5. When paying for products through banks with an encrypted connection, the Customer shall maintain the security of his or her personal banking credentials, and the Web Shop shall not have access to these.
9. Claims procedure
9.1. The Web Shop shall assume liability for any non-compliance of the goods with the terms of the contract and for any defects that manifest themselves within two years from the delivery of the goods to the Customer.
9.2. Upon detection of any defects, the Customer shall have the right to contact the Perfect Home Web shop in this connection within two months, citing the invoice on the basis of which the goods were paid for.
9.3. When discovering any defects in products, please stop using the goods in question.
9.4. The Web Shop and the Customer shall agree on the repair or replacement of any defective goods. The Perfect Home Web shop shall cover the repair expenses.
9.5. The Web Shop shall not assume liability for any defects caused through the fault of the Customer on account of improper storage of the product or failure to use it for the intended purpose.
9.6. In the event of any non-conformities or defects in the product, please send a complaint to email@example.com. The e-mail message should indicate the name of the Customer, a contact phone number, the order number, and precise description of the non-conformity or defect.
9.7. The complaint regarding a non-conformity of or defect in the product must be submitted within two months from identification of the non-conformity or defect.
9.8. All complaints shall be examined and the Customer contacted at the earliest opportunity, always within 14 days after receipt of the complaint.
9.9 If the Web Shop cannot repair or replace the goods, fails to repair or replace the goods, does not eliminate the defect within reasonable time, or causes unreasonable inconvenience to the Customer, the Customer shall have the right to request from the Web Shop either a reduction in the purchase price or termination of the contract and return of the money paid for the goods.
10. The Consumer’s right of recourse to the consumer complaints committee
10.1. If the Web Shop refuses to settle the Customer’s complaint or the Customer does not agree with the solution offered by the Web Shop and finds his or her rights to be violated or his or her interests damaged, the Customer shall have the right to submit a complaint through the Consumer Protection Board to the consumer complaints committee or a competent court. The Customer may submit the complaint on his or her own behalf or through a representative. The contact details of the consumer complaints committee are available on the Web site of the Consumer Protection Board. For settlement of issues arising in other member states of the European Union, please contact the European Consumer Centre of Estonia.
